Supremes Rejects Trump’s Presidential Immunity In NY Sentencing
The Supreme Court on Jan. 9 rejected President-elect Donald Trump’s request to halt proceedings in his New York business records case, removing a potential barrier to sentencing scheduled for Jan. 10.
The brief order noted that Justices Samuel Alito, Clarence Thomas, Neil Gorsuch, and Brett Kavanaugh would have granted the application.
The court offered several reasons it said it refused to grant the application. “First, the alleged evidentiary violations at President-elect Trump’s state-court trial can be addressed in the ordinary course on appeal. Second, the burden that sentencing will impose on the President-Elect’s responsibilities is relatively insubstantial in light of the trial court’s stated intent to impose a sentence of ‘unconditional discharge’ after a brief virtual hearing.”
