A federal court has scheduled a March 10, 2026 hearing in a FOIA lawsuit brought by Judicial Watch on behalf of Open The Books, seeking disclosure of royalty payments made to NIH scientists, including former NIAID Director Dr. Anthony Fauci, for taxpayer-funded inventions. The case hinges on whether the NIH improperly withheld records over claims that revealing individual payments would expose confidential commercial data from patent licensees. Judge Amit P. Mehta found a “genuine dispute of material fact” over the NIH’s arguments and ordered the evidentiary hearing to resolve whether these royalty payment records must be released.
