LAS VEGAS (KLAS) — A former U.S. Air Force commander accused of sexually assaulting an underage girl will have a military pretrial hearing Thursday, more than two years after he was first arrested.

The Clark County District Attorney’s office handed the case against Kevin DiFalco over to military court in October 2022. What has followed is a process with numerous delays within the military while DiFalco still holds a military job.

“On January 10, 2025, an Article 32 preliminary hearing is scheduled to determine whether there is sufficient evidence to warrant a court-martial,” a Nellis Air Force Base spokesperson wrote in an email in response to an inquiry from the 8 News Now Investigators. “The Office of Special Trial Counsel exercised its authority over criminal allegations against Lt. Col Kevin DiFalco in September 2024. Charges were then preferred against him on December 6, 2024.”
